מלבד הפגיעה בהתיישבות החקלאית, הבג"צ הנ"ל מתייחס לישראל כמדינה "כובשת" שהקשר היחיד שלה לאדמת המולדת הוא צבאי בלבד. בכך, פרקליטי המדינה בשיתוף עם  שופטי הבג"צ גורמים למדינה נזק מדיני עצום - בעיתוי אומלל במיוחד כי הפלשתינים הרי מחפשים הצדקה להקים מדינת טרור ביהודה ושומרון בספטמבר.

שרי הממשלה מסכימים שמדובר בבעיה חסרת תקדים בחומרתה. אך כשהשרים ביקשו מפרקליטי משרד המשפטים  להפסיק עם הבג"צ הנ"ל, הפרקליטים סירבו.

The State's senior attornies who have their own very strongly held political opinions, are working furiously to push forward --in the name of the State of Israel -- a High Court of Justice petition that they themselves concocted in 2008. The petition  is believed, by them and by us, to be exceptionally damaging, retroactively and inequitablly, to the Jewish agriculturalists (wine-growers and organic farmers)  in Judea and Samaria. See the link above, in the Hebrew, if you would like to read the State attornies' ultra-radical petition. Another aim of the attornies' petition is to officially declare that Israel's presence in Judea and Samaria is merely that of a military occupation and that Israel has no historic connection to its own Biblical homeland. This at a time when Palestinians are seeking any justification to advance their move to set up a new Palestinian terror state in Judea and Samaria in September, including pushing Israel back to the pre-Six Day War borders  and splitting Jerusalem!!

 

It is NOT necessary to explain to the Ministers that such  a petition would be an absolute disaster - they agree and are aware and that is not the problem. What IS necessary, and this is the real problem, is to URGENTLY clarify to the Ministers that they are going to have to be very, very firm with the State attornies! This past week, the Ministers asked the State attornies to lay aside the petition ("bagatz", in Hebrew). The attornies said no, and that was that. Please SMS (due to urgency!) the ministers  that on Sunday morning (when the weekly government meeting is held), this must change completely and immediately. The ministers must stop ASKING the attornies to lay the petition aside. They must ORDER the attornies to do so whether they like it or not, and must VERIFY that the attornies do as they are told. Simply put, the ministers have to clarify in no uncertain terms, that the dog is not going to allow the tail to wag it. Any attorney who is not comfortable carrying out the duly elected Government of Israel's Land of Israel policies, needs to be shown the door.

Foxman's public pressure on Israel: ADL National Director Abraham Foxman publicly asserted, this week, that it would "help make the case for Israel" if the Netanyahu government decides to present a "diplomatic initiative". Mr. Foxman assured his interviewer that "ninety percent" of American Jews would want the prime minister to "take some kind of initiative". Israel has to enter into a diplomatic initiative "for Israel's sake", Mr. Foxman insisted.

This statement appears to be an ill-advised attempt of Mr. Foxman to apply public pressure to the Prime Minister of the State of Israel ("would help make the case for Israel", "ninety percent of American Jews would want", "Israel has to do it", etc.)  The statement was made by Mr. Foxman at a time in which there is no lack of powerful world figures pressuring Mr. Netanyahu already.
 
Can cause violence, lawfare, incitement: The pressurizing recommendation made by Mr. Foxman could be particularly serious because, international mindset being what it is, each time an Israeli prime-minister offers a "diplomatic initiative", he is expected  to announce a package of territorial and other concessions toward Palestinians. Many concessions made by Israeli prime ministers  to the Palestinians in the course of "diplomatic initiatives" have in the past led to violence, bloodshed, lawfare, international media incitement and other extremely troublesome outcomes for Israel.  For example, Prime Minister Sharon's Gaza disengagement plan vastly increased the ability of Palestinians to lob rockets at large cities in Southern Israel, such as Beer-Sheva, Ashkelon and Ashdod; as well as generating the still-ongoing Gilad Shalit fiasco and serving as backdrop for massive international de-legitimization of Israel, including both the Goldstone Report, which harshly criticized Israel's attempts to protect itself against Gaza, and the Gaza flotilla affair.

  
Just today, Israel's Minister for Strategic Affairs and former Chief-of-Staff, Minister Bogy Yaelon, stated that he is firmly opposed to concessions. Mr. Foxman's pressurizing statement seems to undermine the well-informed warning of the Government of Israel's most senior strategy expert.

Can turn to Mr. Foxman: If you are concerned about Mr. Foxman's pressurizing recommendation,  and feel that such statements, coming  from Israel's disapora, may elbow Israel's prime-minister toward concessions which are dangerous for his country, please feel free to forward this email to Mr. Foxman: afoxman@adl.org, and ask him whether he would be willing to consider withdrawing the pressurizing recommendation he has delivered publicly to the Government of Israel. As you can read in the links in the Hebrew section above, the entire vineyard of a Jewish winegrower from Sussya was destroyed this week. This was an "achievement"  of radical pro-Palestinian, European funded lawfare. Damages suffered by the winegrower, Moshe Deutsch, a father of 10, son of a Holocaust survivor and brother of  Palestinian  terror victim Shaya Deutsch, were tens of thousands of shekels.

 

Urgent and very important indeed: We have just been informed by reliable sources that the harsh, foolish treatment in Susya, will be meted out soon to most agriculturalists in Judea and Samaria -- unless the Government Secretariat immediately takes certain appropriate steps to block continued lawfare efforts  against "settlers".

As you can read in the links in the Hebrew section above, the entire vineyard of a Jewish winegrower from Sussya was destroyed this week. This was an "achievement"  of radical pro-Palestinian, European funded lawfare. Damages suffered by the winegrower, Moshe Deutsch, a father of 10, son of a Holocaust survivor and brother of  Palestinian  terror victim Shaya Deutsch, were tens of thousands of shekels.

 

Urgent and very important indeed: We have just been informed by reliable sources that the harsh, foolish treatment in Susya, will be meted out soon to most agriculturalists in Judea and Samaria -- unless the Government Secretariat immediately takes certain appropriate steps to block continued lawfare efforts  against "settlers".
